Day (Lagos)
March
16, 2003 Chuks
Okocha An Abuja High Court presided over by Justice Sidi D. Bage has struck out a suit instituted against Col. Isa Maina, the Peoples Democratic Party (PDP) senatorial candidate in the Federal Capital Territory on account of constitutional defects. Justice Bage in his ruling said that the suit brought by Alhaji Abdullahi Adamu, the defeated PDP senatorial aspirant, was an abuse of court processes. In the judgement delivered on March 11, Justice Bage stated that "the claim of the plaintiff that the first defendant was indicted by the Nigerian Army. The word "indictment" presupposes a charge or information before a court of competent jurisdiction or like the practice in the Nigerian Army, the first defendant was court marshaled. No prove of either is before this court. Such indictment, if it is to be accepted must be in accordance with section 66 of the Constitution of Federal Republic of Nigeria, which is in pari material with guideline 24 of PDP for primary election 2003. There is nothing before this court to show that the first defendant was indicted and accepted by Federal or State Government." Justice Bage therefore, ruled "The plaintiff¡s claim is therefore founded on nothing." Accordingly, he ruled that; "The plaintiff¡, suit as presently constituted is both constitutionally and statutorily defective and it is hereby struck out of this court." Justice Bage added that the suit brought by the defeated PDP senatorial aspirant is incurably defective because "it is a domestic issue that is non-justiceable in a court of law." He adopted the legal opinion of Chief Afe Babalola (SAN) which is that "The clear position is that a right to be elected into an office is not a civil right. It is only a constitutional right and can be exercised on in accordance with the provisions of the constitution. Where the constitution subjects that power to the jurisdiction of a political party, the aggrieved party can ventilate his grievances only within the party machinery and where he fails, all he can do is to move to another party, where he can realise his constitutional right and no more" The judge also said that going by the 2002 Electoral Act, the court cannot by its decision affect the validity of nomination or presentation of a petition claiming that the candidate was not validly nominated. Also in the letter by Col. Isa Maina's lawyer, Damian .D. Dodo (SAN), to the PDP Chairman, he described the defeated PDP senatorial aspirant in Abuja as a bad loser, who resorted to blackmail. He said that Maina was at no time ever indicted, charged, investigated, arraigned, prosecuted, convicted, or sentenced for any act or misappropriation. He described Alhaji Abdullahi Adamu and his backers as sore losers who having failed in the party primaries and in court by law have now resorted to cheap blackmail, mischief, and complete distortion of facts. ....................................... Monday, October 13, 2003 ..............There are fewer women in politics today, some respondents argued, because tribal women are more busy with their studies and building their career. Jaipal Singh always felt that in a political movement, participation of women was necessary to bring in better discipline. Even the Congress in Jharkhand promoted women like Sushila Kerketta, Muktidani Sumbrui and Sylvia Bage. But women now find it better to devote their time to build their career and this is borne out by the increasing number of tribal women in administration............... ....................................... Museum of Protestant France of the West In full heart of the Vendean scrap-metal, a Protestant residence since XVIe
century, completely transformed into "castle with the Frenchwoman" at the XIXe
century, is bequeathed by Mrs. Bage in 1945 to the Company of history of
French Protestantism. Management is entrusted to the Association of the Wood-Tiffrais
museum. Two parts recall the way traversed by Réformés during four centuries.
The arrival of Calvin in 1534, the impact of large heads as Cop or Duplessis
Mornay during the wars of religion, the edict of Nantes, the seat of the Small
rock by Richelieu, Dragonnades, the Revocation and the movement of the Alarm
clock are evoked here through many iconographic documents. Bibles, psautiers of
XVIe century, works of controversy or theology, often printed with the Small
rock or Saumur, acts established with the Desert and objects such as a pulpit to
be preached or the méreaux ones and their moulds are also exposed. An
audio-visual spectacle evokes, according to its newspaper, the tribulations of
the teacher Jean Migault and his family. Museum of Protestant France of the West, Wood-Tiffrais,
