The Will of Joseph Bage of Tynemouth, Northumberland

This is the last Will and Testament of me Joseph Bage of 40 Church Street, North Shields, in the Parish of Tynemouth, in the county of Northumberland, Coal Merchant. I appoint Joseph Alexander Richmond Ellis, of 20 Dockwray Square, North Shields, House Agent and William Henry Yeeles, of 6 Pearson Terrace, North Shields, Builder, Executors and Trustees of this my Will, whom I direct to pay all my just debts, funeral and testamentary expenses as soon after my decease as convenient. I give, devise and bequeth, my Household Furniture, and other personal effects in my residence, and any remaining monies to my wife Isabella Bage for her own absolute use and benefit and my Business as Coal Merchant including horses, carts and every other thing pertaining to said Business, to my son Joseph Bage for his own absolute use and benefit. I give, devise, appoint and bequeath all my Real Estate whatsoever and wheresoever of which I die possessed of which I can dispose of in execution of any powers or otherwise (hereinafter referred to as the ' Trust Property' ) unto my aforenamed Trustees to hold upon Trust to pay the income of the said Trust Properties, after paying for repairs and management, to my wife aforenamed during her life if she shall so long continue my widow. And after the death or marriage again of my wife I give, devise and bequeath my property in Charlotte Street, occupied as a Coal Store, and the two Houses Nos. 1 & 2 Queen Street, all in North Shields to my son Joseph Bage for his absolute use and benefit, And I direct my aforenamed Trustees to sell the remainder of my Real Estate, together or in parcels by public auction or private contract, as soon as my Trustees find it practicable and pay over out of the proceeds to my son, Joseph Bage, the sum of One Hundred and Fifty pounds and I direct the balance to be divided into fourths and apportioned as follows;- One fourth shall be divided equally between my eldest daughter Elizabeth Ellwell and her eldest son William Aitkin, and in the event of either being deceased to the survivor. One fourth equally between the following children of my deceased son William Proffitt Bage, namely Joseph Bage, Walter George Harrett Bage, William Proffit Bage, Elizabeth Proffit Bage and Agnes Isabella Bage, or as many of them as are living at the division. One fourth to my daughter Mary Jane Nelson, and if she should be deceased an equal division to her surviving children. And the remaining fourth to the children of my deceased son John Vint Bage - namely Joseph Bage, William Howey Bage, Cornelius Stewart Bage, and John Vint Bage, or as many as shall be living at the division. I direct that in the event of any of the aforenamed being under the age of twenty one that my Trustees shall invest the monies in the Savings Bank or elsewhere and shall have power to vary the investments from time to time as they shall think fit for the time being, and any increase arising from same shall be applied for the education of such children or paid to them if my Trustrees think fit during their minority. I also direct that in the event of my son Joseph Bage dying before the death or marriage again of my widow that my Trustees shall also sell the Charlotte and Queen Street Properties and divide the Real Estate into fifths instead of fourths, and that my son Joseph Bage's children shall receive a fifth share equally divided among them. I also direct that in the event of a child in any of the respective families dying before benefiting under this my Will that the remaining children of the family to which that child belongs shall participate in that child's share. I declare also that the receipt of my Executors and Trustees shall be a good and sufficient discharge to any person or persons for any monies required to carry out these my requests or any other matters relating to the faithful performance of the duties enjoined on my Executors and Trustees in this my Will, and my Trustees shall be held indemnified from any depreciation in the value of Securities, or loss which may take place during the performance of such duties. If either of my Executors or Trustees named in this my Will should at my decease be dead or wish to renounce, or should die before the fulfilment of the expressed wishes of this my Will, the remaining Executor or Trustee shall act as if he were appointed sole Executor and Trustee and perform the duties involved in this my Will, and if both my Trustees should be deceased on the death or marriage again of my widow, or during the Trusteeship two New Trustees shall be appointed by the vote of the majority of the anticipated legatees. I also direct that the appointment of my friend Joseph Alexander Richmond Ellis as Trustee shall not invalidate him acting as agent in the collection of the rents, Management, and also the sale of the Properties when the time arrives, for which services he shall receive reasonable remuneration. I hereby revoke all other Wills and Codicils In witness whereof I have hereunto set my hand this fourth day of August in the year One Thousand Eight Hundred and Ninety Four.

was proved and registered in the District Probate Registry of Her Majesty's High Court of Justice at NEWCASTLE-ON-TYNE and that Administration of the personal estate of the said deceased was granted by the aforesaid Court to Joseph Alexander Richmond Ellis of 20 Dockwray Square, North Shields aforesaid, House Agent, and William Henry Yeeles of 6 Pearson Terrace, North Shields aforesaid, Builder, the Executors.
